What do I need to prove in a personal injury case?

When you take legal action against someone who you believe is responsible for causing your injury, you must prove 4 key points in your case. These are:

  • Duty of Care: You must be able to show that the defendant had a responsibility to take reasonable care to prevent an injury.
  • Breach of Duty: You must be able to show that the defendant violated his or her duty of care by acting negligently.
  • Cause: You must be able to show that the breach of duty led to your injuries.
  • Damages: In order to pursue a lawsuit, you must be able to show the total value of your injury-related costs for which you are seeking financial compensation.

Our Louisville personal injury attorneys can help to guide you through each step of your legal proceeding to ensure that you properly address each of these key points in your case.
